My $.02: Every lawyer with any modicum of intelligence knows that Roe was a ridiculous stretch and wrong from a Constitutional law perspective. But from a policy perspective, I think it was sheer genius. The problem is that it came from a non-legislative branch, and non-legislative branches cannot set policy. In my view, a Federal law enshrining Roe would be a great solution.
